Asbestos & Your Business: How it Impacts Renovations

It’s hard to imagine another word that has caused more concern when uttered for such a long time. This word has caused more project delays and cost over runs than any other that comes to mind. We are still constantly bombarded with advertisements from personal injury lawyers, promising you monetary relief from a product that was for the most part banned from use in 1989. In 1989 the Environmental Protection Agency (EPA) issued a final rule under the Toxic Substance Control Act (TSCA) to prohibit the manufacture, importation, processing and distribution of asbestos-containing products. The ruling was overturned in 1993, however, allowing for certain asbestos-containing products to be manufactured in the United States. Over 20-years later we are still dealing with government regulations to handle asbestos. Because asbestos presents a significant risk to human health when released to air, asbestos is considered a hazardous air pollutant regulated under the EPA National Emission Standards for Hazardous Air Pollutants (NESHAP) regulations.

What are EPA NESHAP Regulations and How Do They Impact Your Business?

EPA NESHAP regulations are Federal regulations under the Clean Air Act (CAA) that apply to business owners and contractors. Asbestos NESHAP regulations address common business activities, such as demolition, renovation activities and waste disposal issues.

Asbestos has been used in the production of building components since the 1880’s with over 3600 different products available to the average consumer and business. In a report to congress in 1988, the EPA found that “friable” (easily crumbled and rendered air-borne) asbestos-containing building materials (ACBM) could be found in over 700,000 businesses.

NESHAP regulations require that prior to any renovation or demolition activities, you must first inspect your facility or the affected portion of your facility for the presence of asbestos-containing building materials (ACBM). An accredited Asbestos Inspector must perform this inspection. With over 3600 ACBMs out there it is critical that your business retain an experienced Asbestos Inspector who, in consult with an accredited Asbestos Project Designer, can make the word asbestos less painful to utter.

Taking Control of Workers’ Comp Costs

In a recent issue of National Underwriter, Dave Lenckus gave readers 3 tips for controlling their organization’s workers’ comp medical costs. Much to our liking, the tips are ones we’ve been giving to our clients for years.

Establish a Culture of Safety

Proactive loss prevention is absolutely essential for work environments. Maintaining proper safety throughout an organization can decrease the occurrence of injuries which will ultimately lower your workers‘ comp claims. We encourage our clients to exhaust all efforts in order to prevent losses before they happen.

Fraudulent Claims

While maintaining proper safety is critical for injury prevention, employers must also be well prepared for when an injury does occur. Legitimate or not. With recent economic events, employers have seen spikes in workers‘ comp claims following, and often just before, layoffs. Many workers will consider reopening or a filing a new workers‘ comp claim as a source of income.

For many of our clients, we suggest that they diligently conduct ongoing testing of assorted physical functions related to a job within their organization, such as hearing exposure. This will give employers the most accurate baseline measurement that they can track and respond to quickly at the first sign of problems, instead of after a claim has been filed.

Making the Right Hires

Fortunately the economy appears to be strengthening, and many of our clients are experiencing an increase in orders and are rehiring to keep up with production demands. Whether our clients are hiring 1 or ten new workers, we encourage them to adopt at least two practices to avoid hiring high-risk workers.

Before a new worker is hired, it is important that a pre-employment physical be conducted. The potential hire will be screened by a doctor to ensure that he/she can safely perform the job, and any prior physical ailments will be identified and recorded.

Once a potential hire has been deemed a good fit for an organization, a thorough new hire orientation must be completed to familiarize the new hire with the work environment and to ensure he/she has a strong understanding of what is required from his/her position.

Employers can’t completely eliminate all risks involved, but there steps that can be taken to prepare for defending against those risks. Managing workers’ comp takes foresight, preparation and execution, but business owners and managers don’t have to go at it alone. Comp-SIGMA can help!

The Importance of Effective Job Hazard Analysis

A proactive approach in preventing injuries and accidents in the workplace by observing workplace operations, establishing proper work procedures, and ensuring each employee is properly trained is required to maintain a safe workplace free of hazards.  We here at Comp-SIGMA want to reinforce the importance of using a Job Hazard Analysis; a technique that focuses on job tasks as a way to identify hazards before they occur.  If you can identify hazards and successfully eliminate or control them, you will greatly reduce exposure which leads to injuries and illnesses.

We recommend that you involve your employees as they have an understanding of the job process, and this information is extremely valuable.  Reviewing your accident history and near misses are other important steps in order to figure out which jobs need immediate attention.

Observe the employee perform the entire job, and record enough information to describe each job action is necessary.  You have now successfully completed a step by step analysis of a job that has the potential to lead to employee injury or illness.

Breaking down each step and implementing a change in job task is your next responsibility. Eliminate steps where an employee is exposed to a hazard, if an injury is likely to occur, and if there are potential consequences to the employees health and safety if the task is not changed. Implement and train the employees on any revised changes to their job tasks. Don’t forget to review past Job Hazard Analysis, and conduct future analysis if any part of the job has changed.

Being proactive and actively involving your employees in your Job Hazard Analysis will help create a safer workplace, as well as encourage a greater safety culture within your workforce.
